5. Acceptable use

All content, features, algorithms, risk models, and functionality on the Redberry Labs platform are the property of Redberry Labs and are protected by applicable intellectual property laws. Redberry Labs grants you a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes. You may not reproduce, distribute, or create derivative works from any Redberry Labs content without express written permission.
7. Insurance-specific terms
Quotes are not guarantees
Receiving a quote from Redberry Labs does not guarantee that coverage will be issued. Coverage is confirmed only once a policy is issued and in force.
Duty of disclosure
You have a duty to disclose all information that is material to the assessment of risk for each agent you submit for evaluation. This includes — but is not limited to — the agent’s permissions, tools, operational context, deployment scope, and any known incidents or failures. Failure to disclose material information may result in your policy being voided or a claim being denied. If you are unsure whether information is material, disclose it.
Policy terms control
The terms of your insurance policy — including coverage limits, exclusions, deductibles, and conditions — are set out in the policy documents issued to you. In the event of any conflict between these Terms of Service and your policy documents, the policy documents control with respect to coverage.
Regulatory compliance
Insurance is regulated at the jurisdiction level. Coverage availability, terms, and regulatory requirements vary by location. It is your responsibility to ensure that obtaining and using AI agent insurance complies with applicable laws and regulations in your jurisdiction.
8. Fees and payment
Fees and premiums are described at the time of application and policy issuance. Redberry Labs reserves the right to modify fees with reasonable advance notice. Payment processing is handled by third-party payment processors; by providing payment information, you authorise charges in accordance with your policy and any applicable platform fees.
9. Disclaimers
The Redberry Labs platform and services are provided on an “as is” and “as available” basis. Redberry Labs makes no warranties, express or implied, regarding the platform, including any warranty of merchantability, fitness for a particular purpose, or uninterrupted availability. This does not affect the terms of any insurance policy issued to you.
10. Limitation of liability
To the maximum extent permitted by law, Redberry Labs will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the platform or services. Redberry Labs’ total aggregate liability to you for any claim arising from these Terms of Service is capped at the greater of: (a) the total fees you paid to Redberry Labs in the 12 months preceding the claim, or (b) US $100.
This limitation does not apply to obligations under any insurance policy issued to you. Claims under your policy are governed by your policy documents, not this cap.
11. Governing law and disputes
These Terms of Service are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute arising from or relating to these terms or your use of the platform will be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Wilmington, Delaware, in accordance with the AAA’s Commercial Arbitration Rules.
